Once again, that is something you, as a consumer, should be complaining about to your game console manufacturer. One of the many issues with game consoles today is they require licenses from the console maker to create a game on them. As to were a PC is open, and requires no such silly rules.

It is not the ESRB's job to worry about how the market reacts to a rating, it's their job to rate games. It would be unfair if they gave a game a rating below AO just because they didn't want to kill the game. It is their job to give an accurate depiction of the content in a game in an easy to read format. I may not think they do a perfect job, but it would clearly be a mistake to give a game a rating it did not deserve.

Hehe, I feel weird defending the ESRB because I used to be strictly against them, until I actually looked up what they did and how they did it.
