That "thanks" makes it a transaction, not a donation, and therefore illegal in this case.

No, it doesn't.

You're pretty much saying "Donate $10, and you get stuff!" It's called a donation, but it's actually buying.

Yes but its still donating. Its all just a legality. Prefect example, public broadcasting station. They have fund raisers in which when you donate a certain amount, they give you a gift of the DVD of who ever is playing or performing. Now, selling that DVD for $150 isn't legal, but donating for it is.

I'm going to bring in religion, which I know doesn't apply to every Government and its laws in the world, but I'll do it anyway.

In Islam, donations are also talked about. For something to be a donation, one has to give away something without __expecting__ something in return. The possible loop hole (or not, depending on your opinion) is that you might not expect something but you do end up getting something, in which it is more of a gift back; you didn't expect it and made the contribution anyway believing you were getting nothing in return. That said, if you then go tell your friend that if you donate $5 and you get a CD, he/she knows shes expecting something, and it doesn't then apply as a donation. In this case, you see it happening to someone else or if it is publically stated, then it means it isn't a donation, but a transation. You donate $4.99 and it remains a donation, go $5 or more and it becomes a transation; unless you then deny taking the gift.

I quite often buy things from charity shops, but it isn't a donation; and it doesn't go towards my Zakat (kind of like an annual donation to charity; although it doesn't necessarily have to be done on the year, some people break it down and do it monthly, weekly, etc).

It's the law. Illegal to charge for things you don't own the copyright for.

a better statement to follow up Falacy's post is that it's BYOND's policy to prevent games with copyrighted material from being displayed on the BYOND Hub when they charge money.

whether it is illegal or not, is not the issue here. BYOND has chosen to do this to minimize any potential backlash if a copyright holder comes knocking on the door complaining about the use of their 'property' without permission.
