Before I continue, I had no idea where to put this, and ended up deciding that this would be the place. If this is deleted or closed or something I can only guess that I put this in the wrong place.
Now, I've posted a couple of ads for fangames. I was about ready to make a complain whne I looked over the rules another time, and after a few more glances at the third rule, I realised that the games may be counted as a copyright infringement. Correct me if I'm wrong, but wouldn't it be a copyright infringement if I was earning money from it? Because I'm not going to. Also, does this mean BYOND allows fangames but we have to use materials other than the developer forum to find help?
Thank you to anyone who can at least answer one of my questions or can make an intelectual comment on what I've posted.

Copyright infringment occurs anytime you infrinite on a copyright, obviously. You don't have to be making any amount of money. You simply have to be using anything whatsoever that is covered by that copyright.
In response to your second question, yes, you can make a fangame. It is technically illegal (though rather unlikely that these companies will actually pursue it), so BYOND doesn't want to out-right allow it on the developer forums. Regardless, you can put it on the hub, and BYOND anime will add it. | |

No, you don't have to be making money in order to be infringing on copyrights. Technically its illegal to create works based on copyrighted material without the copyright holder's permission, and while you probably won't get in trouble for doing it, we certainly aren't going to encourage it here.
So while we can't stop you from making the game, we can tell you to go do it somewhere else.
