It's not even the legality of it. The BYOND hub is not a porn friendly environment. It never has been and it never will be. BYOND is no more likily to add a porn section than the Disney Store.
They know that people can get porn easily enough on the internet, and that your parents should be watching you to make sure you're not looking it up, but they still don't want BYOND to be a place where you find it.

In it's simplest form the argument breaks down to this;
-You're allowed to create what ever you want, and host what ever you want, using BYOND.
-The BYOND Staff do not care what you host, when you host it or how you host it.
-The only time the BYOND Staff care is when you try and distribute/advertise on their hub (and in turn, website). If they don't think that it's appropriate then they'll simply remove the hub entry and ask you to advertise somewhere else.

So if you have something that the BYOND Staff doesn't want on their hub/website all you have to do is make your own website and put the address up there.

It's also important to note that Strai isn't in trouble for making or hosting Hentai Hill, he's in trouble for constantly trying to put it up on the hub despite being told it's not acceptable.
If he had of just done what was suggested by the BYOND Staff and distributed the address himself instead of trying to force it onto the hub he wouldn't have got in any trouble at all.
