Hello.

I would like to know if downloading mp3s off a program that finds about every mp3, and transfering to a cd or my mp3 player would be legal.

Yes, if you payed for a subsciption to the program, or are a comcast highspeed user.

Rhapsody is the only one that allows this, but even then i don't think you are allowed to burn them.

Doesn't matter. You can pay a subscription and it wouldn't change the legality of anything. If, however, you are buying the mp3s from someone who legally owns copies and is selling those copies(ie iTunes), then it could possibly be all right.

No, its legal. comcast wouldn't be offering a free subsciption for a week if it wasn't legal.

Not legally owning COPIES, legally owning COPYRIGHT.

And some services which charge a subscription, but still own copyright, would also work.

Anything peer-to-peer is not legal, though, as far as I know.

What Jon said is that subscription doesn't change anything, and he's right. Rhapsody is not legal because they charge subscriptions. It's legal because they've secured the rights, which gives them a means to charge subscriptions without filing for taxes in a creative fashion... if they chose to give away the music for free and foot all the bills themselves, they'd still be legal. Broke, but legal.

A music-sharing/downloading program being subscription-based says nothing about its legality... you may just be paying for the right to use a peer-to-peer file sharing program with a hefty disclaimer saying that the service is not responsible for how you use it... or you may be paying for the right (the actual right granted in some form by the copyright holder, as opposed to the mere ability granted by someone who runs a peer-to-peer network) to download from a catalog of music, in which case the downloading is legal... but of course, what you're entitled to do with your downloads afterwards is another question.
