That's like saying you are going to sue Microsoft because someone used some ripped graphics on a webpage created with Expression <_<

BYOND is in no way legally obliged to moderate what people do with the software once they download it.

Anime fan games do a lot to bring awareness to the anime. The studios know that. Also, if it's just some free RPG based around characters and themes (much of which cannot actually be copyright, since many anime studios simply borrow from japanaese mythology and history to name thier character s and develop their themes.)
