From say, a SNES game on your BYOND game, is it still a fan-game?

How unfair is THAT. I dont want to make a Dragon Warrior fangame yet, but I want to use Dragon Warrior Graphics...

Then don't violate copyright.

By that logic the fangames on BYOND = Illegal.
In response to King of Slimes
Technically, yes. But no one cares unless the copyright holder takes action against them.

They are illegal.

So tell the companies to sue BYOND then.
In response to King of Slimes
They probably wouldn't bother. It's still illegal, though, and there is a potential that Dantom could be sued for knowingly allowing their existence on the hub.
In response to Jp
I thought it was illegal if you made MONEY off of it?
In response to King of Slimes
Wrong.

What is copyright?

Copyright prevents you taking other people's work. Pure and simple.
In response to Jp
Hmmm, didnt know, well somebody is gonna sue Dantom someday then BYOND will cease to exist.
In response to King of Slimes
Probably not.

Actually Square-Enix (creators of Final Fantasy and Dragon Warrior) encourage Fan-Games. They are only illeagel when the owner is making any profit off them.

They're illegal NO MATTER WHAT. You CAN BE SUED for infringing their copyright, EVEN IF YOU DO NOT MAKE MONEY OFF OF IT.

Seriously, please know what you're talking about. If the company tacitly encourages fangames - fine. It's still illegal unless they say that people are allowed to use their copyrighted material in games.

They couldn't. BYOND only provides the means to make the game. It doesn't steal their work for people.
Besides, fangames are often poorly programmed and never attract the crowd they should attract (instead of *real* fanboys only some teens and adolescents with no lives. Not to say that a real fanboy has a life but I don't see your average BYONDer camping out for the latest Naruto movie).

So will I, or anyother BYONDer, or Dantom, get into a lawsuit/ get sued if I make a fangame?
In response to King of Slimes
That's somewhat unlikely - it is a theoretical possibility.

I don't think you'll get sued, but it is illegal.

Arrested? Would I get arrested?
In response to King of Slimes
You can't get arrested for copyright infringement. Just sued for damages. And I don't think that's likely.
