I am still confused over this matter.
Is a fangame allowed to give BYOND membership perks?

I checked with the BYOND Staff just before Members were released and yeah they're fine with it.

Not so much 'OK' with it as we haven't had the chance to discuss it in heavy detail yet -- we decided until we have a more indepth discussion we'll allow it. Chances are it'll be allowed anyways, but there's no solid decision on it yet.

Well if one of the big companies were to come along and decide to make a fuss about it, it could be a problem.
Basically doing that BYOND is getting money, but what is there to stop someone from doing it themselves? To have a similar setup, Bob has his Naruto Ball Z game and wants to make a couple bucks off it. Bob goes to John and after a little talk, John setup a site that offers Blog hosting in his name, and as an extra incentive, anyone who signs up gets Jitsu-Saiyan 5 in NBZ. Now the above situation, obviously Bob would be getting some money under the table otherwise he wouldn't have a reason to do such a thing, but the fact remains someone is still making money off of that fangame, and I'm sure if they're coming down about it they wouldn't particularly care who is making money, just that someone is, even if only indirectly (and if they don't; Hello Loophole!) |

I'm going to have to agree on this one, about the fact that BYOND is making money from something that is fan based. If creators of games aren't allowed to get subscriptions for the game, then I don't think BYOND should get them either.
However, the fact is, though, that people who make fan games that aren't out to make a profit or whatever off of their fan games, obviously put the member perks in their game for a reason. Main one more than likely being the fact that only members can vote for their game, and they're giving perks for votes. So overall, it's a fair trade, I suppose. |
I had an idea on a perk for members which I will be adding into one of my fan games.
It's a DW game, so members, once they beat the game, will have access to a bonus dungeon with any character they finish the game with, and will have an extra boss and ending. §atans§pawn |
The point here is motive. Does BYOND have any control over whether these people are offering perks based on BYOND Membership? Perks based on BYOND Membership are offered solely at the developers' discretion, not at BYOND's discretion.
It's a touchy subject and I'm sure it could go either way in court, but BYOND's policy as of late has always been a firm "hands off", and I figure that will also serve them here. |
