A rip is a rip is a rip. If it wasn't hand coded and all the art isn't original, as in, also made from scratch, it's a rip. For instance, my Pikachu game thing has ripped material. (Don't go play it if you value you lives.)

uh, no they have not, and we (the BYOND staff) would appreciate not dragging us into this sort of bullshit. especially without proof.
