Tom didn't tell anybody they couldn't host their naruto games. He told the community that they couldn't post infringed material on the hub. What people host in their games, though, is totally outside of anyone's ability to control.

No. By definition it could not possibly create more original content because preventing the proliferation of existing content has nothing to do with creating original content.

BYOND is only responsible for material hosted on the BYOND servers, not on individual games. A C&D != a lawsuit. It's a notice of infringement. A C&D isn't a bad thing. It's a letter saying: "Hey bro, you should knock this shit off. Legally we can't sue you until you've had time to comply with this."

Again, BYOND will never get sued for what dbz games or naruto games do because BYOND is in no way culpable for what's done with the software. They are only responsible for what gets put on their website, and there's a legal provision called "safe harbor", which gives website owners immunity over the actions of their userbase. We've had in-depth conversations about this provision in the past.

Tom's past behavior is not indicative of what the law has to say. If what you are saying is true, then it's the duty of ever murderer to murder, and the duty of every thief to thieve. Just because someone did something in the past doesn't make it their legal responsibility to have done that.
