Then again, he said something, not somethings. So I don't think it is the tree, cause the grass is also alive. As are those people far back in the right hand corner(if I am not mistaken).

Well, after adjusting it's colors, looking aat shadows, color changes, etc, only thing I could find would be, well, the tree and people in the back.

But wait, James Wiseman is living, isn't he? ;-) If you aren't talking about the people or tree or grass, that's what I'd say. THe words "James Wiseman" is in the picture, and he is living.
