Shades - "You wanna know what half of Byond isnt shut down by FunImation or Atari [Atari currently holding all rights to any DBZ games]?.

Because half, or all of the Byond DBZ games suck eggs bad enough, to where they KNOW it wont be a problem.

if what you say is true, and this is totally awesome, consider it totally shut down in an instant. And the worse part of it is, the company can turn around, and use the exacate idea and be legally free. [not steal your source code, but use your idea.]

You don't think this dosent happen all the time? Byond is small time man, and people dont waste their time with small time stuff.

But lets look back on "The Chrono Trigger Project" where a developer was working with a nintendo gamecube kit, and was activaly re-creating the entire first Chrono Trigger game in 3D, and it looked gorgeous! They had screen shots, movies, all sorts of stuff, everyone was so excited.

then came along SquareEnix, who threatend by this project gave them a cease and disist order. The rest is history, the best fan game ever made and it was shut down by some insecure pricks.

Anyways, the fact is, it can, and more likley will be shut down, if its anything like your getting so excited about."

Do you realize that companies don't care if they're small enough? Why do you think the music industries sued thousands of people for downloading COPYRIGHTED material which was original their own? Sure, it was a private residence but it was still illegal and wrong. No one cares how small a community is. Someone could make an idea large...large enough that many many people would play. I.E. Runescape, Endless Online, Ranagarok, etc. Yes, they could take our ideas and use them against us but so what? I'd rather them do that then be in debt for the rest of my life or jail.

I personally think Square Enix was a bunch of idiots. Instead of actually shutting it down, y not buy it? Not only would that make the fans happy as hell, a cool game, complete with programming! Oh jolly gee, what a great deal... And with some touching up, cooperative work, boom, a great game ready to be sold... Just my opinion though.

Again you've got to realise there is no 'they'. All big companies don't get together and decide how they're all going to handle this stuff.
Some companies like Fan Material because it builds up the fan base, others don't like it because they could potentially loose money over it.

Lot's of big companies don't care about small scale fan stuff because it's not worth shutting them down. Sure they have the resources, and it's not going to take much effort, but it's bad for public relations.
For instance Rockstar Games wouldn't go around shutting down fan games (unless they really had to) because they've got an image to protect. It simply wouldn't be worth looking like the man.

It also depends on what sort of fan material it is. Viz might be out to get the people who are fan subbing Naruto, but that's not to say they're automatically going to be out to get people making fan games. They're two completely different things.
They might decide that Naruto Online is worth the potential lost (or that it'll never get finished, so there's no point in shutting it down and looking like Ogres), whereas there's no upside to people giving away bootleg copies of their TV series.
I doubt they'll ever let them release Naruto Online, but there's a chance.

That's different. That's people downloading their material for free, this is people making games based on their material.
With the music there's a definant financial loss with no real compensation. With FanGames the loss/gain isn't as fixed. There's a lot more factors. So naturally different people are going to come to different conclusions on whether the loss is worth the gain.
