Legality Issues

I was think of having the theme 'Hunter's Chance' as World music but as it is also a theme in FFIX i am wondering if it would bring up legal issues and/or lawsuits. Or would a simple disclaimer bypass this. The game is NOT a Fangame.

It's just as "bad" as using ripped icons, although you see them all over fangames anyway (even though you said yours isn't).

I assume that as long as you use it, you can't charge money or your game but nobody will beat down your door over it.
