As a creator, I'd stand by calling it wrong. :P It's also illegal, but it's illegal because it's wrong.

Legally, you can ask for donations for your labor and services, but you can't make payment required for playing a fan game.
Illegally, you can practically do anything you wish in a BYOND fan game, because it's such a small form of media, realistically the owners of the original thing wouldn't spend any time in a legal case or anything of the sort, because it would end up as a waste of time in small claims court.
Don't worry about it, if you feel you need to ask for donations, then do so, nothing can really prevent you.
