Validity of this Game?

I was wondering if this game could be proved as a rip of this game just because it was created after the latter.

note-They use the graphics from a common source (GBA LOG games) (thats why they look alike).

I think people that churn out anime games faster than a clothing sweatshop start overlapping with their game names honestly.

Can I ask why you decided to call your game that? You even slip up a couple of times and call it Heroes United.
