And I worded the first post incorrectly. That should have been, "illegal, whether or not money is exchanged."

I understand the issue, but I'm not sure why you're getting yourself involved, Silk. Based upon my revenue from the past few weeks since the explosion, not to mention the potential I see for exponential growth in the future, NEStalgia has officially become a cash cow. I have a very legitimate interest in BYOND's existence and stability, and fan games selling subscriptions is a huge threat to that. I'd rather not have to deal with this problem, as I have a million other things on my plate right now. That said, it *must* be dealt with. Falacy's attitude, plus the fact that I've had a lot of fan game kiddies coming onto NEStalgia to spam and cause trouble lately has simply served to bump this up on my priority list. |
I feel like this is turning into a TV show. I'm out. BYOND has far too much drama, I'm sticking to programming.

Be that as it may, sending an email to copyright holders and making this public only fuels the fire. If getting back at Falacy is the point here I can understand why you'd post this, but otherwise, it would be a lot more effective to contact the staff personally. Any protection Falacy has, you (as the owner of NESTalgia) certainly have. What is this blog post supposed to accomplish? The support of the community is irrelevant in this issue, especially because most of them aren't even of age to consider this stuff at all. And besides, if those vindictive players spamming NESTalgia get their favourite game shut down, by making this post you're only guaranteeing your suffering.

Toadfish: Fan game creators on BYOND (not just Falacy) don't seem to understand what a serious situation this is. They need a wake up call. Getting this out in the open for discussion will also help to give Tom a sense of just how much the legitimate game creators in the community want him to squash fan games that sell subscriptions.
Neblim wrote: A little off topic, but, mind if I ask how much you been making? I'm just curious. :) Pretty inspiring that you managed to get it attracted to a large handful of people anyway. I'd rather not "kiss and tell" just yet, but I may give out that information down the road as a means to motivate other BYOND developers to promote their own projects. Let's just say that right now it's enough money for me to treat working on NEStalgia as if it were a full time job for the foreseeable future. |
Anime game creators aren't going to realize anything any time soon. I'm sure you know this. Whatever concerns you have for your financial investment, surely Tom's concerns about his business are several times as big. If you have a private conversation with him over this matter, he's likely to be understanding. Did you do so? You may have legitimate reasons for posting this, but all I see here is you guaranteeing more spam in your game, and more drama (of the stupid kind) in the community.

I'm now manually hiding this blog post from the front page so that the problem can be officially addressed at a later date.
Falacy and any other fan game creator who is selling subscriptions should consider themselves on notice: you're soon to be done making money off of an IP that you don't have the rights to. Better to make that change yourselves right now. |
Didn't Nadrew already do this exact thing a couple of years ago, and he was told that they didn't care?
|
I really do hope something's done about fan games around BYOND as a whole; not just the ones that make profit. I personally don't believe stealing intellectual property is venerable by any means.
Edit: Funny story, Falacy told me BYOND was given permission by copyrighter holders of Dragon Ball (In which he can't even list a single company that owns the franchise) to make fan games. I mean, making such a blunt idiotic claim really is fruitless. |

An unverified email sent in 2001 or 2002 from Funimation isn't going to protect anyone -- especially when there is money being exchanged. Namco Bandai now specifically holds the rights to DBZ games, and they will not play nice with people who blatantly rip off their IP for profit. |
Why you hate anime so much?
Selling copyrighted stuff such as icons, yes that's illegal. But, why so much hate? D: |

I don't see him as hating anime really. From what I can see it's the unrighteousnesses of content users did not create.

It's shameful. I've made many fan games, but never charged a cent for it. How can someone sleep at night doing that. Knowing that every second, of every minute, of every hour of your life, at any time, you can get sued. I'd never be able to live with myself.

As I mentioned, this is the same nutjob behind Hentai Hill. Strai is the type that will keep breaking rules until he is forced to stop - warnings and other stuff like that don't bother him. DBHU isn't coming down anytime soon, especially when his archenemy is the one making the threats. He'd probably rather hang himself than have to do what Silk tells him to do. |

I'm gonna take EmpirezTeam's comment as an advice, and just ignore this whole thing. After all, Falacy will most likely suffer gruesome consequences anyway. No matter how disappointed I am, at his.. terrible yet unfairly successful choice of gaining.. all that money, it's best to see what the higher authorities, or staff will do. |
