As some of you may know The Mothball made arrangements for hosting through my services. He hosted a stolen game.. one of the dragon warrior games. He knows of our terms and agreements regarding theft and rips and still asks for a refund. I have 2 options in my mind and would like any thoughts or opinions
1) refund him
2) send the dimes to the rightfull owner of the code for any damages and/loss he might have encountered for the theft of his code.
Any and all opinions are welcome because i am torn as of what to do....

I'd have to say half and half, you don't need him bugging you about his dimes, so refund half, and just keep half for yourself, you did have to go through the trouble setting up his account, as long as he wasn't charging to play the owner of the game doesn't need anything.

true but for me it isn't an issue about money i could care less i find more enjoyment in running the thing but i dislike thieves and surly the owner if suffering some from having his code out there isn't he?

It really depends on if the owner released the source on his/her free will.

The owner was contacted and it is a closed source it was stolen by the person the mothball

Then you should ask the owner, but if that's the case then I say you keep half, and the owner gets half.

It's not your place to decide what is right to do with his money, or at least that part that he didn't receive services for. If you want to compensate the original code owner, do so with whatever part of the money you might keep for services rendered. |

Even thou it is a business for me, i do not feel i should benefeit from this in any way i would only want somone to do the same if it were my code in question.

Generally most hosting sevices don't refund for a violation of ToS, it compensates for setting up and removing the account, and offending files.

Look at it this way, if mothball here payed you to host a game that he knew was against said agreement, hes not entitled to recieve a refund. He knowingly violated the agreement, and knowingly payed you while violating that agreement. IMO you shouldn't refund any of his money, either keep it or give it to the owner(out of charity, because it doesnt seem like hes lost anything over it).

I agree, If you bought a computer, got the extended warrenty, and then dunked it in some water while it was on and the warrenty didnt cover that, do you think the company would give you back your money or fix your computer? No.

Personally,I don;t like him and his games because I know the person he stole the game from in real life. So I think you shouldn't. You told him the rules and he broke them. Why forgive him? He will believe he can get away with stuff like that and try to do something like it again :( Just completly forget about him.
