Well the New Super Mario Brothers was totally leaked today early and I totally downloaded it.

The game is awesome. Its like they took the best elements from all the other Mario games and smashed them into a new Mario Brothers game.

The music is fantasic, the worlds are colorful and challegening and its Mario, what else need I say?

I like this game so much, it is avaible to buy in the stores, I am totally buying it.

Good job Nintendo.

Yes it got leaked, i've seem it in a well known irc channel. Its defintly combined features from every mario game. The levels feel like mario 1 but the moves and shells you can get feel like the later games.
I once said "I will get this game from a friend" and got banned for three days, yet you guys sit here and rant off about downloading a leaked console game before it comes out. :P

I better see some bold, green text appear in this thread topic soon or BYOND is totally unjust, haha :D

I wasn't the moderator who issued that ban, so I was going to let them respond; but they don't seem inclined to do that, so I'll answer for them.

Your ban was the result of a long history of similar behaviour, during which I believe you were warned several times. This situation does not bear comparison. Please stop trying to second-guess moderation decisions. Thanks.

Sorry, maybe if the BYOND moderation was organized or consistent at all I wouldn't have to second guess them. :P

Is that against the rules too? ^_~ If it is, I'll certainly stop*, but as it stands now, there's no way for anyone to really know what the rules are because they're enforced on a whim rather than from a list of offenses.

One day making a sly, non-direct reference to pirating software is a bannable offense, yet a month later someone can blatantly state they're downloading a console game that was leaked before release.

So, what BYOND has is a handful of different moderators with a handful of different positions on topics. If, say, a moderator had a deep an undying passion for ham sandwiches, would that give them to right to issue a ban to a user who makes a remark about eating a ham sandwich?

What BYOND needs is a structured list of rules clearly stating what is and what is not against the rules.

As for a "long history of similar behavior" ... Yeah, I was warned a couple times in regards to similar posts to what Shades has made here, and I stopped. The post I was suspended for stated nothing about pirating software, and was enforced without much grounds.

The problem with directly stating what is against the rules is that people WILL try to say: "Well, it doesn't say it is against the rules, so it is ok, and if you do anything about it..." you get the point.

I really think you are making mountains out of mole hills. Yes, shades did directly say that he did pirate a game and I have seen him do it before(Or something close), but it is still up to the mods to decide. This is the best system for moderating a small group like this.

BYOND doesn't have a government, and short of the members area, there is no real legal reason why they can or can't ban whoever they want(The members area, being something that is paid for, has to be dealt with differently because the user did pay for services, but he also agreed to certain terms).

AFAIK the moderators are not employed by dantom. So it would be safe to say the moderators don't have to have the same positions on the same topics. They do have to act in dantom's best interests.

And frankly, how do you know the guy that posted this topic wasn't warned?

As I said before, it all depends on context. The moderators have logs we can look at, we have discussions of past history, and so on. If our methods seem impenetrable, it's because you can't see the history (or lack of such) that we're basing our decisions on.

It would be counterproductive to continue this discussion, so thread closed.
