Hi im Elliot and very frustrated at the moment. Im the co creator of the game Dragonball Z: Unstoppable Power but i found the theres a guy by the name on Maykay2 and i noticed that my game information and my name is on his site http://www.byond.com/members/Maykay2 and on a game he is making http://www.byond.com/games/Maykay2/ DragonballZReturnofVegetasNightmares
i couldnt get onto the game to see if hed stolen any of my icons or any of the game so i tried messaging him. he ignored me so i went on a game he was on and confronted him. he woulnt give me a straight answer and a friend of his said he was having "the right to remain silent" and the i should expect something to be stolen if i put it online. Surely thats not what byong is about and im thinking about removing the games download as id hate for my hard work to get used by some thieving ******.

As your icons are likely DBZ-related (and probably just edited, ripped icons), you have no more right to the icons than he does. The true owner of the copyright is the one who has the legal say to the icons.

Fan works, including works of art, are part of the copyright of the owner of the character they depict. A fan drawing of the Starship Enterprise would be copyright of Paramount, even though someone else drew it, because it would be considered a derivative work. The artist could only claim authorship, not copyright -- the artist can prevent other people from signing their own name on the drawing, but cannot prevent the company from abrogating the drawing without royalties or insisting that the drawing be destroyed.
A parody drawing of the Enterprise, or a drawing inspired by the Enterprise, would be solely the copyright of the artist. The company could threaten legal action, and the artist would be responsible for defending it as fair use. Note, of course, that a company cannot restrict you from drawing media for your own private, non-commercial use -- that's fair use. So, for instance, if you want to draw a furry, naked Captain Kirk who is an ocelot and set it to your computer's desktop, Paramount can't do a thing about it. It can, however, restrict you from selling that image or allowing that image to be downloaded or otherwise played in an online game by strangers, as it is their copyright by nature of being derived from Captain Kirk even though there are considerable differences (you know, being naked, furry, and an ocelot). |

I came on this site in 2004 and me and a friend decided to try and create a game that wasnt a rip that used orignal icons and original gameplay to improve byond. We created a game that we would want to play and that the people of byond can play. We created the game with nothing but good intentions and what most people on here have reacted negatively towards me and that anyone can steal anyones work. Well that quite frankly makes me sick. Byond is always seemingly trying to encourage game makers to create games from scratch. Well if someone else is getting credit for my work i would wish i had never done anything in the first place.
If its allowed that original icons can be stolen then game makers should be told about this before they start. I still hope byond staff will react to any thieving of icons and other peoples hard work. |

It's not allowed, but the Staff won't do anything. Assume you're creating your own work (in other words, stuff that isn't copyrighted, like a fangame), then they are your's, and you have a legal right to force others to stop using them.

Also ive looked on Maykay2's site and he has my name and my game information on the homepage BUT he also has a bit where he is SELLING his Non-rip resources.

Hire a lawyer and sue, Provided that the icons are yours, and you also own the copyrigt on them, you will win. Otherwise your basicly out of luck, sadly there is nothing anyone here can do for you.

Report him for copyright infringement, as he is selling those fan game icons. Just be sure to come off as a formal, concerned user, and not someone out for revenge. Also, note that it's not your copyright he's breaking, but the owners of DBZ/Megaman.
