Ones based off of games, rather then animes but it's still a fangame none-the-less.

The question is: Would I ever get into legal trouble if I never make a profit? (donation or other method)
I've always wanted to make a fangame off of two games since I was a kid, but never knew if I'd get in trouble.

I believe the same rules apply as you are copying someone else's work.

I doubt Capcom would care but I believe BYOND would surpress the hub.

They have always had the rule where you can not make any sort of money off of copyrighted material. You can build a fan game if it is your "net dream", you just can't make money off of it.

Generally speaking, if you don't own the copyright and haven't been given permissions, than you can't do it, legally. Copyright infringement is copyright infringement, even if you aren't making money.

BYOND works on the rule of thumb that, if you aren't making money, are you probably helping the original content creators by drumming up support, so it's unlikely that they will take action. However, if fundimation, for example, decide they didn't like all these anime games based of their IP, then they could contact Tom and force him to remove them from the hub, and they could pursue the individual game creators, however, I believe they would need to receive a Cease and Desist order first.

However, moving out of TV shows and into copying other games, this is a direct threat to funds, at least as the developers see it. Many game developers have been very strict in their pursuit of unofficial games. Megaman, for example, is a direct challenge to the Megaman games out there. I remember one particular case where a kid decided on remaking Zelda: Ocarina of Time in 2D. He got featured on TechTV, and shortly after Nintendo shut him down, because they felt it directly threatened their business in relation to Zelda. Honestly I don't agree with their choice in action, but I would guess that it would be typical.

Ocarina of Time was already in 3D! The game he was working on was A Link to the Past. They closed it down because Nintendo had considered making it themselves.

You can build your own net dream. If it's someone else's dream and you just want to make it, there are legal limits. It's not BYOND's fault there are copyright laws that could shut down the site, so don't act like they're doing it.

it's always been my dream to play a multi-player megaman game by me.

but oh wait, just wait, that cant happen because you guys are several times more strict about this crap then a few months ago.

to this point: we cant build our own net dream unless it's original, who said we want that?
furtheremore, what am i supposed to do, email Capcom asking if i can make a 100% free Megaman game on a service called BYOND and expect you guys to believe me if they even replied?

It's not legal to make fan-games. You just have a lower chance of getting sued as long as you're not turning a profit.
